Here at plotLight we believe your privacy is important — that's why we provide this notice explaining our information practices. This notice is available from the plotLight website and is referenced in the plotLight Terms of Service.

Information Collected by plotLight

In general, plotLight receives and stores any information that you provide to us, including any information that is provided automatically by your web browser or ISP.

Prior to joining the plotLight service, when you are browsing plotLight's public web pages, we collect industry-standard information that is automatically provided by your web browser. This information may include your IP address and HTTP request headers. Additionally you are automatically assigned a semi-unique ID.

Because the plotLight BRAIN is an advanced machine learning tool, any information that you provide to us may be used as part of training for this software. In addition, some information you provide to us may be used directly as part of plotLight BRAIN suggestions or recommendations.

If you choose to email plotLight, we will receive and store your complete message.

Use of Cookies

Cookies are small identifiers that we transfer to your web browser to enable our system to recognize you — for example, cookies are used to identify your session when you login. You may choose to reject our cookies or delete them at any time, however certain portions of our site will not operate if you choose to do so.

How we use your Information

plotLight is a information tool; we use your information to provide service to you. We are not in the business of selling your information to others. Generally speaking, the only time we share your information with others is when you request that we do.

We use the information you provide about yourself to provide the plotLight service to the extent that such is necessary for our service. We do not share your information with outside parties unless you request that we do, or such is necessary to provide our service. For example, if you opt to share your project with a colleague via the plotLight service, information necessary to complete this request will be shared with your colleague.

Our service generates a variety of automatic email messages that are central to our service, for example messages alerting you that your paperwork is ready for retrieval. While most of these messages are only generated when you request, some messages are central to our service and must be sent to members. When you email us, we use your return email address to answer your email. If we particularly like your email we may want to use it in our marketing, but we will ask for permission first. Additionally, we may sometimes select plotLight members to receive promotional offers from us. If you do not wish to receive these messages, adjust your account settings.

We may review or release information you have provided to us when we believe it is appropriate to comply with the law, to enforce our Terms of Service, or to protect our rights or safety. For example, we may exchange information for fraud protection or when compelled by a government agency.

If plotLight engages in a business transfer, such as the sale of the business or acquisition of another business, your information will be transferred to continue operating the service. Unless you agree otherwise, the promises made in this notice will remain in effect. In the unlikely event that our assets were to be acquired, customer information will obviously be transferred as an asset of the company.

Security of your Information

Because plotLight values your information, as soon as you login to the plotLight system all of your transmissions are protected by industry-standard Secure Sockets Layer (SSL) encryption. You may disable SSL protection in your account settings page, however we do not recommend you do so.

When you use the plotLight LiveLink system, your project data is available publicly if we are provided the corresponding LiveLink locater ID. You may select to password-protect your LiveLink if you wish.

You should take appropriate actions to help safeguard your information as well — for example make sure you logoff when you are done using plotLight, especially if you are using a shared computer or device.

Children's Privacy

Children are not permitted to use the plotLight service, or access the plotLight web site, without the direct involvement of a parent or guardian. Our service is not targeted to children.

Accessing your Information or Correcting Information

You can access your information by entering your account and making changes from your account settings page. You can also modify your email preferences here. To protect your privacy and security, your must be logged in before you can change your information.

When you terminate your plotLight service, we will store your information for a minimum of six (6) months. After this period, we may, at our discretion, remove some or all of your information from our equipment.

Changes to this Policy

We may change this policy at any time, however we will never materially change our policy to be less protective without your consent.

This content is protected by the copyright laws of the United States as well as international treaty. Our trademarks and trade dress may not be used in any manner that may confuse potential or existing customers, or in any way or manner that disparages our service. Logos that are not owned by us are the property of their respective owners.

License to use our Service

plotLight grants you a limited license to use our site such that you do not store or modify any portion of it without our express written consent. You are not permitted to resale or use for any commercial purpose any portion of our service or its contents or collected information. You are not permitted to use any automated collection tools, such as data mining tools or robots, with our service. No portion of our site or service can be reproduced, duplicated, copied, sold, visited, or exploited for any commercial purpose without our express written consent.

You may supply us with a variety of information, such as the information necessary to describe your project, so long as such information is not illegal, obscene, threatening, distasteful, defamatory, invasive of privacy, violating intellectual property rights, or otherwise injurious or objectionable. In addition, you may not supply information which contains a software virus, or in any way attempts to cause the plotLight service to operate in a unexpected or exploitive manner. You may not attempt to use the plotLight service to send any form of unsolicited email. We reserve the right to remove or edit any content that we believe violates these terms, at our own exclusive discretion. However, we do not regularly review the information you provide, and accept no obligation to do so.

When you chose to provide information to us, you grant plotLight a nonexclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. In addition, you grant us the right to use the name you provide or email address in connection with your content, if we believe such is appropriate and a part of the service we provide.

Any time you select to provide us with information, you warrant and represent that you own or otherwise control all of the rights to the content you provide, that the content is accurate, and that the use of the information does not violate this policy and will not cause injury to any person or entity. In addition, you agree to indemnify us for all claims resulting from information you provide. We take no responsibility and assume no liability for your information

Storage of Information

As part of the service, we will store your information on our equipment for the purposes of providing our service. Accounts that attempt to store an unreasonable amount of information, at our sole definition and discretion, will be terminated.

You may not store information on our equipment for any other purpose than the express purpose of our service — for example, you may not attempt to use the plotLight service as a web hosting or file hosting service.

We take a variety of industry-standard practices to ensure the safety of your information. However, we assume no responsibility or liability for the safety of your information in the event that actions outside of our control jeopardize or destroy your information. You should take appropriate action to ensure the safety of your data, including performing your own backups.

We will attempt to store your information for at least six (6) months after you terminate your account, however events outside of our control may cause us to destroy your data earlier. In addition, we reserve the right to store and use your information longer than six (6) months, up to and including indefinitely. Even if we elect to terminate your account, we may continue to store and use your information if your account was not terminated as a result of providing prohibited information.

Continuity of Service

plotLight offers no Service Level Agreement for our service, which means that while we take industry-standard precautions to ensure you can always access the plotLight service there may be times when you cannot access our service. Lack of access can occur for a variety of reasons which are not necessarily within our control. We assume no liability or responsibility to provide continuous and always-available access to our service.

Pricing and Billing

plotLight is a membership service that requires the payment of a monthly fee if you choose to use and continue using our service.

We make every attempt to ensure our web site lists our current and accurate service fees, however occasionally the fees displayed on our web site may differ from the fees listed when you enter the checkout process. In the event that this occurs, the fees listed in our checkout system are the correct and accurate fees.

By joining our service, you agree to have your provided payment method automatically billed every month for the total membership fee of our service, which includes the core membership fee and any add-ons you select. At no time will we pro-rate billing, which means that you will be rebilled every month starting from the date you join our service. We reserve the right, at our discretion, to define a month as 30 days even if the current month has 31 or 28 days.

If we offer you a free trial period, you will not be billed for any membership fees until the expiration of your trial period. You may not combine free trial offers with any other offer, and additional terms may apply as specified in the free trial offer. If you were required to provide a payment method prior to the commencement of your trial, we will begin automatic billing as soon as your trial expires. You may view your trial information, and the date of your next billing, from your account page. When you provide your payment method, we may choose to attempt to authorize one-months service fee with that payment method. As such, your financial institution may temporarily lower your spending power on such payment method, as described in your agreement with them. If you were not required to provide a payment method prior to starting your trial, we will warn you a few days prior to the expiration of your trial to do so. When your trial expires, you will be required to provide a payment method to continue service.

Your membership to our service will continue until you cancel service, and cancellations will occur immediately. Unless otherwise provided by our Money Back Guarantee, we provide no refunds for partial unused months. To cancel your service, visit your account settings page of your account.

Membership fees are paid at the beginning of billing periods, and are earned immediately upon payment. At any time, for any reason, we may provide refunds, credits, discounts, or bonuses to some members at our discretion. The offer of credits (etc) to some members does not necessarily entitle any other members to said credits, and the receipt of credits (etc) in the past does not indicate such credits will be offered in the future.

From time to time we may change our membership fees, however we will provide advance notice of any changes.

Right to Terminate

We reserve the right to terminate, modify, or restrict your use of our service at any time, without notice, for any or no reason whatsoever.

Identity Protection

In order to access your account, you must provide your email address and a pre-selected password. We may, at our discretion, utilize technology to recognize your computer and allow access to your account without the need of retyping your password.

You are responsible for maintaining the confidentiality of your account and password. You are not permitted to disclose your account or password to anyone else, and doing so may result in termination of your account.

If you access plotLight from a public device, you should logout of the service when your visit is complete.

In the event you believe your account is being accessed without your knowledge, contact us immediately to have your account suspended.

Limitations on Use

You must be 18 years of age or older to use our service without the direct involvement of a parent or guardian.

Any unauthorized use of our service or its contents will terminate the limited license granted herein and will result in the termination of your membership.

The parties agree that in the event of a dispute or subsequent legal action, they will only assert claims in an individual (non-class, non-representative) basis, and that they will not seek or agree to serve as a named representative in a class action or seek relief on those other than themselves.

If any provision or provisions of these terms shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby, and shall remain in full force and effect.

Claims of Copyright Infringement
